Crime Victims Rights

Crime Victims have been given certain rights by the legislature and the office of the prosecutor is responsible for the enforcement of such rights. The crime victims are eligible for the following basic rights.

  • Right to request for non disclosure of their identity to the public
  • Right to notification for plea negotiations
  • Right to witness the sentencing
  • Right to restitution
  • Right to object to a settlement

Following rights are available to a Crime Victim in the process of trial.

  • Notification of their basic rights by the prosecution.
  • Notifying and informing the victim about the conditions of a pre-trial release of the defendant.
  • The victim should be informed about the terms of a plea agreement and his right to participate.
  • Get notified prior to referring a person for a pretrial diversion.
  • The victim should be given the notification of the court’s decision not to prosecute the defendant or dismiss the case.
  • The prosecution is responsible for notifying the victim regarding the schedule of changes.
  • Victim can request for a speedy trial of the case within the stipulated time period.
  • The courts are supposed to grant a separate waiting area for the victims in the courthouse, which are sufficiently safeguarded.
  • Crime victims are not required to disclose their addresses unless otherwise required by the court of law.
  • A statement of impact borne by the victim otherwise called the pre-sentence investigation report is prepared and the victim is educated about his basic rights in the case.
  • The court is required to notify the victim on the defendant’s release and issue pertaining to it.
  • The victim has the right to present the impact statement at the time of sentencing.
  • The victim has the right of notification regarding final disposition.
  • Victim can request to review a hearing.
  • Crime victims are eligible for financial compensation for the personal injury suffered.
